1. Introduction

Welcome to GameOutreach ("Service", "we", "us", "our"), operated by Maryan Mandzyuk, a sole proprietor based in Ukraine, doing business as GameOutreach ("Operator"). GameOutreach is a SaaS tool that helps indie PC game developers discover YouTube channels for game marketing outreach. Although we are based in Ukraine, all our infrastructure (servers, databases) is hosted within the European Union, and we comply with the General Data Protection Regulation (GDPR) as we offer services to users in the EEA.

By accessing or using GameOutreach at gameoutreach.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement. By using the Service, you represent and warrant that you meet these requirements.

3. Account Registration and Google Sign-In

GameOutreach uses Google OAuth 2.0 for authentication. When you sign in with your Google account, we receive basic profile information (your name, email address, and profile picture) as permitted by Google's authentication scopes.

You are responsible for maintaining the security of your Google account and for all activities that occur through your GameOutreach account. You must notify us immediately of any unauthorized use.

We do not store your Google password. Authentication is managed entirely through Google's secure OAuth 2.0 protocol.

4. Description of the Service

GameOutreach provides tools for indie PC game developers to discover and research YouTube channels relevant to game marketing outreach. The Service uses the YouTube Data API v3 to retrieve publicly available information about YouTube channels, including channel names, descriptions, subscriber counts, video counts, and other publicly available metadata.

The Service is designed to help developers identify potential marketing partners and is not intended to facilitate spam, harassment, or any form of unsolicited bulk messaging.

GameOutreach uses the YouTube Data API v3, and by using our Service, you also agree to be bound by:

All data retrieved through the YouTube API is publicly available channel metadata. We do not access, store, or process any private or authenticated YouTube user data on your behalf beyond what is required for the core functionality of the Service.

We do not store YouTube API data for longer than 30 calendar days. Cached data is automatically refreshed or deleted within this period to comply with the YouTube API Services Terms of Service.

7. Payments and Billing

7.1 Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. This means that when you purchase a subscription or any paid feature, you are purchasing from Paddle, and Paddle handles all billing, invoicing, tax collection, and payment processing on our behalf.

7.2 Pricing and Subscriptions

Current pricing and subscription plans are available on our website. All prices are inclusive of applicable taxes, as calculated and collected by Paddle based on your location.

We reserve the right to change pricing at any time. For active subscribers, price changes will take effect at the start of the next billing cycle, and we will notify you in advance.

7.3 Refund Policy

Refund requests are handled in accordance with Paddle's refund policy. You may request a refund within 30 days of purchase or the most recent subscription renewal. To request a refund, contact our support team at mandzyuk.maryan@gmail.com or contact Paddle directly.

Paddle reserves the right to grant or refuse refunds at its discretion, in accordance with its Checkout Buyer Terms and applicable consumer protection laws.

7.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation, you will retain access to paid features until the end of your current billing period.

8. Intellectual Property

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, software, and code) are owned by the Operator and are protected by applicable intellectual property laws.

YouTube channel data retrieved through the YouTube API belongs to the respective channel owners and YouTube/Google. We do not claim ownership of any third-party content.

9. Data Protection and Privacy

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. Although we operate from Ukraine, all our infrastructure, including databases and servers, is hosted within the European Union, and we comply with the GDPR for all users within the European Economic Area.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

We do not guarantee the accuracy, completeness, or reliability of any data retrieved through the YouTube Data API or any other third-party service. YouTube channel information may change at any time, and we are not responsible for outdated or inaccurate data.

11. Limitation of Liability

To the fullest extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising out of or related to these Terms or the Service shall not exceed the amount you paid to us (via Paddle) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Service or your violation of these Terms.

The Service integrates with or relies on third-party services, including but not limited to:

We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of third-party services is subject to their respective terms and policies.

14. Modifications to the Service and Terms

We may modify the Service or these Terms at any time. Material changes to these Terms will be communicated via email to your registered email address or through a prominent notice on the Service at least 30 days before they take effect.

Your continued use of the Service after modifications take effect constitutes your acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your account.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

Sections that by their nature should survive termination will survive, including but not limited to: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Ukraine.

For EU/EEA consumers: nothing in these Terms affects your statutory rights under applicable EU consumer protection law. You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and the Operator regarding the Service.
